What is the 10-year divorce rule in Michigan?

Under Michigan law, after 10 years of marriage, one spouse may be entitled to a portion of the other spouse’s Social Security benefits, military pension and workers’ compensation benefits. This is not automatic, however. The receiving spouse must be age 62 or older and cannot have remarried. This is a complex issue which is often vigorously contested. It is best to work with an experienced lawyer in these cases.

Is spousal support mandatory in Michigan?

Not necessarily. The court determines if one spouse is eligible for spousal support/alimony from the other spouse based on their specific circumstances. Both party’s income and earning capacity are taken into consideration, as well as the age and health of each person, and the duration of the marriage. Each case is carefully evaluated and it may help to have a family court lawyer make your argument for or against alimony.

Where do I file a family law case in Michigan?

For divorce, you file in the family law division of the circuit court where you or your spouse live. For custody cases, you file in the family division of the circuit court in the county where the child resides.
